Choosing a Georgia lawyer when you or a loved one have been seriously injured or killed is an extremely important decision.  As Georgia trial lawyers, we have dedicated ourselves to representing individuals who have been seriously injured, killed, or financially harmed by the actions of others. We serve as local counsel for lawyers outside of Georgia and welcome opportunities to associate on significant cases throughout the United States.

We are Georgia trial lawyers who recognize that personal injuries not only cause physical pain, but often emotional and financial hardship through loss of work, medical bills, and stress placed upon families and loved ones. We often take our physical and mental well-being for granted—until something goes wrong and our lives are forever changed. Simple pleasures become chores. Daily routines are disrupted. Economic losses are often devastating. Whether caused by an automobile accident, defective product, or other negligent, careless, or reckless conduct, our goal is to offer you aggressive legal representation in a highly ethical manner so you can focus on getting better and spending time doing the things you love again.

Unlike a general practice firm, we are Georgia trial lawyers who only accept cases where an individual has been seriously injured, killed, or financially harmed by the actions of others.  We do not represent defendants or insurance companies.

What We Believe

After a catastrophic wreck, insurance companies, product manufacturers, and/or company representatives will send a team of experts to the scene of the wreck to look at the vehicles, interview witnesses, collect evidence, and shape the opinions of the investigating authorities.  These teams are on 24-hour standby and can often get to scene before the vehicles have even been towed away.  These teams have one goal in mind:  shifting responsibility to you, the victim.

We believe that you have a right to your own response team that is able to represent your interests.  As Georgia trial lawyers, we work with top experts throughout the country who are skilled in accident reconstruction, biomechanics, kinesiology, product engineering, economists, and/or human factors.  When you call, we conduct a thorough investigation from every angle.  If we accept your case, you will never pay us a dime, unless and until we favorably resolve your case.

We also strongly believe in an individual’s right to a civil juror trial.  In preparing your case, we will work from day one as if your claim was going to trial.  This means that we will not take shortcuts and will give your case our complete attention.  Most cases will not go to trial.  However, we set a tone from the beginning that will get the attention and respect of the insurance companies and corporations who have seriously injured, killed, or financially harmed you or a family member.

Finally, we believe in serving our community and country.  The Georgia trial lawyers at Werner Wetherington give back at every opportunity and have a proven record of service to our community.

Cases We Accept

The Georgia trial lawyers at Werner Wetherington represent individual who have been seriously injured, killed, or financially harmed by the actions of others.  These claims take many forms depending on your unique circumstances.  In Georgia, the plaintiff must prove every element of his or her case.  The following are some examples of the types of cases we may bring on your behalf:

Negligence is the failure to use reasonable care. Negligence is present when an individual’s careless act or failure to act has caused injury. While the act may be unintentional, the defendant may still be liable for damages. There is often liability insurance for acts of negligence, provided by auto insurance, homeowner’s insurance, or another general liability insurance policy.  A common example of negligence is a tractor-trailer driver causing an accident by following too closely to another vehicle and/or driving too fast.

Strict liability generally applies to a product liability claim, which is filed against a manufacturer or product supplier for a dangerous product that causes injury.  Corporations carry large insurance policies and/or self-insured retention policies to compensate victims of defective and dangerous products.  A common example of a strict liability claim is a tire manufacturer failing to use a safer design in its tires.

Punitive damages often arise due to intentional or reckless misconduct that results in an injury or death. If the misconduct results in death, the family of the victim may recover punitive damages under some circumstances that are intended to deter other wrong-doers from engaging in similar conduct.

Wrongful Death claims arise from the death of a family member who has been killed by the negligence or misconduct of another.  Under Georgia law, individuals have the right to recover “the full value of the life of the decedent without deducting for any of the necessary or personal expenses of the decedent had he lived.”  The “full value” of a life in Georgia is not limited to those items having proven monetary value, such as lost earnings, but include the loss of enjoyment the deceased person has experienced.  The Georgia trial lawyers at Werner Wetherington have carefully handled wrongful deaths claims for over a decade and have created a special page on this issue for you to learn more.  Click here to view this page.
