Case Study: Trucking Accident Causes Life-Changing Injuries

The facts below have been modified to protect client confidentiality. The legal issues, strategy, and lessons are representative of serious trucking cases handled by Werner Law.

“There Was Nowhere for Him to Go.”

One of the most serious trucking accident cases our firm handled involved a commercial truck driver who failed to follow basic safety rules and caused a devastating collision. Our client was traveling lawfully when a tractor-trailer entered his lane of travel and created an unavoidable crash. The impact was violent. Unlike an ordinary car wreck, the size and weight of the truck multiplied the force of the collision and left our client with catastrophic injuries. He required emergency medical care, hospitalization, extensive treatment, and a long recovery. His injuries affected his ability to work, care for himself, and live the life he had before the crash.

The Client first hired a lawyer that claimed to be a “Trucking Lawyer.”  Just because a lawyer or law firm claims to specialize in trucking or motor carriers does not make it true.  After that lawyer pressured the client to take a settlement that was far below the full value of his case, he hired Werner Law.  When Werner Law became involved, we knew the case required immediate investigation as very little had been done, and we feared that evidence would be lost. Trucking companies and their insurers often begin protecting themselves within hours of a crash, and we were way behind. Our job was to move quickly, preserve evidence, and uncover the full truth.

The Legal Problem

Trucking cases are different from ordinary automobile cases. Commercial trucking companies must follow safety rules designed to protect everyone on the road. Those rules include requirements involving driver qualification, training, supervision, vehicle maintenance, hours of service, inspection records, and safe operation.

In this case, the defense attempted to argue that the crash was simply an unavoidable accident. The evidence showed otherwise.

Our investigation focused on whether the trucking company and driver followed the safety rules that apply to commercial motor vehicles. We examined whether the driver was properly trained, whether the company adequately supervised him, whether the truck had been properly maintained, if the driver was over his hours permitted by the Federal Regulations, and whether fatigue, distraction, speed, or poor decision-making contributed to the wreck.

Building the Case

We immediately sent preservation letters demanding that the trucking company preserve critical evidence, including driver logs, electronic control module data, dash camera footage, GPS records, dispatch communications, maintenance records, inspection reports, driver qualification files, hiring documents, training records, and post-crash investigation materials.

That evidence mattered.

The case was not just about what happened in the seconds before impact. It was about the decisions made long before the truck ever entered the roadway. We worked to determine whether the company placed profit over safety, whether it ignored warning signs, and whether better training or supervision could have prevented the crash.

The Turning Point

The case changed once the trucking company was forced to produce records showing what it knew, what it failed to do, and how the crash could have been prevented. The evidence demonstrated that the collision was not random. It was the result of unsafe choices, poor oversight, and a failure to follow basic trucking safety principles.  For the first time, it became clear that the trucking company was going to have to admit they were the cause of the collision. At that point, the focus shifted from whether the defendants were responsible to the full measure of damages our client had suffered, and will suffer for the rest of his life.

The Outcome

Following extensive litigation, the case concluded with a significant recovery for our client. The resolution accounted not only for the medical expenses and income losses already incurred, but also for future surgery, lost wages, and pain and suffering.    The result was literally more than four times the amount of what the previous “trucking” attorney tried to get the family to take.

The settlement provided resources for ongoing treatment, future care needs, and the economic impact of permanent injuries. More importantly, it allowed our client and his family to regain a measure of stability after a collision that had disrupted virtually every aspect of their lives.

Holding Trucking Companies Accountable

Commercial trucking collisions are rarely caused by a single moment of inattention. More often, they reveal a chain of decisions made by drivers, dispatchers, safety directors, supervisors, and corporate management. When safety protocols are ignored, maintenance is deferred, or unqualified drivers are placed behind the wheel, the consequences can be catastrophic.

This case serves as a reminder that trucking companies have a responsibility to protect the motoring public. When they fail to meet that responsibility, injured victims deserve answers, accountability, and full compensation for the harm they have suffered.

At Werner Law, we focus on uncovering the complete story behind a truck wreck—not just what happened at the scene, but what occurred in the days, weeks, and months leading up to it. By tracing the evidence, identifying safety failures, and exposing preventable risks, we help ensure that trucking companies are held responsible when their conduct causes serious harm.

For our client, the case was about more than compensation. It was about obtaining accountability, securing his future as well as his families future, and making certain that the safety failures that caused this collision could not simply be ignored.
