Case Study: When a “Mild” Crash Caused Life-Changing Brain and Spine Injuries

The facts below have been modified to protect client confidentiality. The legal issues, litigation strategy, and outcome discussed are representative of traumatic brain injury and spinal injury cases handled by our firm.

“Everyone Expected Me to Get Better. I Didn’t.”

The collision was not huge.  The vehicle was repairable, and the injuries minor.   At least that is what everyone initially believed.

The emergency room records documented a concussion, headaches, neck pain, and low back pain. X-rays did not reveal any broken bones, or other obvious traumatic injury that required immediate attention. The insurance company quickly labeled the claim as a routine soft tissue injury and assumed our client would make a full recovery within a matter of weeks.

That never happened.

As the days turned into months, our client continued to experience debilitating headaches, memory problems, difficulty concentrating, dizziness, and mental fatigue. At the same time, persistent neck pain began interfering with nearly every aspect of daily life. Advanced diagnostic testing eventually revealed multiple herniated discs in the cervical spine. Activities that had once been effortless—working, exercising, driving, household chores, and spending time with family—became difficult and painful.

The collision had caused far more than temporary injuries. It had fundamentally altered our client’s future. When our firm became involved, the insurance company was still attempting to characterize the claim as a relatively minor injury case. Our task was to prove the full extent of the harm and demonstrate how the collision had changed our client’s life physically, cognitively, emotionally, and financially, despite the minimal damage to his car.

The Challenge

Traumatic brain injury cases are among the most difficult personal injury claims to prove. Unlike a broken bone, many brain injuries are not visible on traditional imaging studies. Victims often look normal to friends, coworkers, and even healthcare providers despite struggling with significant cognitive impairments. Insurance companies frequently seize on that reality.

In this case, the defense argued that our client’s symptoms were subjective, temporary, and unrelated to the collision. The spinal injuries were treated similarly. Despite MRI findings showing cervical herniations, the defense attempted to minimize the significance of the injuries and suggest that the treatment was excessive, and that our client was exaggerating the injuries. The central issue became whether the collision had truly caused the profound limitations our client was experiencing. The evidence ultimately answered that question.

Uncovering the Full Scope of the Injuries

Our investigation focused on understanding not only the diagnoses but also how those diagnoses affected our client’s everyday life.

The Brain Injury

Medical providers documented persistent symptoms consistent with traumatic brain injury, including:

  •         Memory deficits
  •         Difficulty concentrating
  •         Irritability
  •         Headaches
  •         Mental fatigue
  •         Delayed processing speed
  •         Difficulty multitasking
  •         Sleep disruption
  •         Emotional changes

The injury impacted our client’s ability to work efficiently, manage daily responsibilities, and participate in activities that had once been second nature.

The Neck Injury

The collision also caused significant spinal injuries. Diagnostic imaging revealed multiple herniated discs in the cervical spine. These injuries resulted in:

  •         Chronic neck pain
  •         Radicular symptoms
  •         Muscle spasms
  •         Reduced mobility
  •         Sleep disturbances
  •         Physical limitations affecting work and recreation
  •         The physical pain became a constant reminder of the collision.

The Combined Effect

What made this case particularly significant was the interaction between the injuries. The brain injury affected cognition, concentration, and mental stamina. The spinal injuries affected mobility, comfort, and physical function. Together, they created limitations that neither injury alone would have produced.  Our client was forced to navigate both chronic pain and cognitive impairment simultaneously.

Building the Case

Rather than relying solely on medical records, we developed a comprehensive picture of our client’s life before and after the collision. We obtained and analyzed:

  •         Emergency treatment records
  •         Neurology evaluations
  •         Advanced MRI studies
  •         Neuropsychological testing
  •         Pain management records
  •         Physical therapy records
  •         Treating physician opinions

The medical evidence consistently linked our client’s symptoms to the collision.

Some of the strongest evidence came from people who knew our client best. Family members described noticeable changes in memory, personality, focus, and energy levels. Coworkers observed a decline in productivity and an increased difficulty handling responsibilities that had previously been routine. These witnesses helped demonstrate the real-world impact of the injuries in ways medical records alone could not.

Future Damages Analysis

The case required a careful assessment of future losses. We worked to establish: ongoing treatment needs, future medical expenses, future pain management care, potential surgical considerations, loss of earning capacity, permanent physical limitations, and long-term cognitive challenges. A serious brain injury case cannot be evaluated solely on what has already happened. The future consequences are often the most significant component of the claim.

The Defense Strategy

As is common in traumatic brain injury litigation, the defense attempted to focus on isolated facts while ignoring the broader picture. They emphasized the absence of a skull fracture, or brain bleed. They emphasized that our client remained physically active to some degree. They emphasized periods where symptoms fluctuated.  They claimed that our client was either faking or greatly exaggerating his injuries as an explanation why our client’s life looked dramatically different after the collision than it had before.

The Turning Point

The case shifted when the evidence was viewed collectively rather than piecemeal. The defense could challenge individual symptoms. They could challenge isolated treatment decisions.

They could challenge individual complaints. What became impossible to challenge was the consistency of the evidence across multiple sources. Treating physicians documented the same symptoms. Diagnostic imaging confirmed structural injuries to the spine. Neuropsychological testing demonstrated cognitive deficits. Family members observed significant changes. Employment records reflected diminished performance and reduced capacity. When viewed together, the evidence painted a clear and compelling picture of permanent injury.  The conversation was no longer whether our client was injured, but rather, how much will it cost the defendants to settle for causing the injuries.

The Resolution

The case ultimately resolved through a substantial settlement that reflected the serious and lasting consequences of the collision. The recovery accounted for:

  •         Past medical expenses
  •         Future medical expenses, including pain management and surgery
  •         Lost income
  •         Reduced earning capacity
  •         Cognitive impairment
  •         Chronic pain
  •         Diminished quality of life

The resolution provided financial security and access to the resources necessary for continued treatment and long-term support. More importantly, it provided accountability. Our client did not choose to live with chronic pain, cognitive challenges, and permanent limitations. Those losses were imposed by another person’s negligence. The legal system exists to provide a remedy when you are injured through no fault of your own.

Lessons From This Case

Brain injuries and spinal injuries often present challenges that are not immediately obvious.

  •         Symptoms Matter: Headaches, memory problems, dizziness, neck pain, and back pain should never be dismissed after a collision. Even when initial imaging appears normal, significant injuries may exist.
  •         Recovery Is Not Always Linear: Many victims expect symptoms to disappear within weeks. For some, recovery takes months or years, and some symptoms may never fully resolved.
  •         Documentation Is Critical: Consistent medical treatment and accurate documentation often become essential in proving the true extent of an injury.
  •         The Future Must Be Considered: The value of a serious injury case extends beyond medical bills. Future treatment, lost opportunities, diminished earning capacity, and loss of quality of life often represent the most substantial damages.

Why This Case Matters

Some cases involve injuries that are immediately visible. Others involve injuries that reveal themselves over time. This case fell into the second category. The collision left our client with a traumatic brain injury, multiple cervical disc herniations, chronic pain, cognitive limitations, and permanent changes that affected virtually every aspect of daily life. The insurance company initially viewed the claim as a minor accident and discounted our client’s injuries. The evidence told a very different story.

At Werner Law, we understand that serious injuries are not always obvious.  We work to uncover the complete impact of a collision, document the full extent of our clients’ losses, and pursue the compensation necessary to help them move forward. Whether the injury involves the brain, the spine, or both, our commitment remains the same: tell the full story explaining the extent of our client’s injuries in order to maximize the result that our client deserves.
