Plaintiff was fixing a broken down vehicle on the side of the road when a commercial vehicle driver who had been ignoring the Federal Motor Carrier Safety Regulations veered out of the right lane, entered the shoulder striking our client.

Cases We Accept

We represent individuals who have been seriously injured or killed by the actions of others. In Georgia and around the country, the plaintiff must prove every element of his or her case. The following are some examples of the types of cases we may bring on your behalf:

• Negligence is the failure to use reasonable care. Negligence is present when an individual’s careless act or failure to act has caused injury. While the act may be unintentional, the defendant may still be liable for damages. There is often liability insurance for acts of negligence, provided by auto insurance, homeowner’s insurance, or another general liability insurance policy. A common example of negligence is a tractor-trailer driver causing an accident by following too closely to another vehicle and/or driving too fast.

• Strict liability generally applies to a product liability claim, which is filed against a manufacturer or product supplier for a dangerous product that causes injury. Corporations carry large insurance policies and/or self-insured retention policies to compensate victims of defective and dangerous products. A common example of a strict liability claim is a tire manufacturer failing to use a safer design in its tires.

• Punitive damages often arise due to intentional or reckless misconduct that results in an injury or death. If the misconduct results in death, the family of the victim may recover punitive damages under some circumstances that are intended to deter other wrongdoers from engaging in similar conduct.

• Wrongful Death claims arise from the death of a family member who has been killed by the negligence or misconduct of another. Under Georgia law, individuals have the right to recover “the full value of the life of the decedent without deducting for any of the necessary or personal expenses of the decedent had he lived.” The “full value” of a life in Georgia is not limited to those items having proven monetary value, such as lost earnings, but include the loss of enjoyment the deceased person has experienced. We have handled wrongful deaths claims with respect and compassion for over a decade.
